These Software Terms of Use ("Terms") govern your access to and use of the software, platforms, portals, and digital tools (collectively, the "Software") made available by Hawaii Financial Services, LLC ("HIFIS," "we," "us," or "our") in connection with mortgage origination, processing, and related services. HIFIS collects personal information you provide through the Software, including your name, email address, phone number, and financial information, solely for the purpose of processing your mortgage application. HIFIS will never sell or share your personal data with third parties except as required by law or as necessary to process your mortgage application (e.g., lenders, title companies, appraisers). 5. Intellectual Property
All content, features, and functionality of the Software — including but not limited to text, graphics, logos, and software code — are the exclusive property of HIFIS or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Software solely for the purposes described herein.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HIFIS DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HIFIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF HIFIS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
